Mason Carey conclude Party Wall matters in Tunbridge Wells

Mason Carey brought a successful closure to Party Wall matters at a High Street development in Tunbridge Wells this week.

We acted on behalf of the building owner to undertake works associated to the Party Wall etc. Act 1996 which involved issuing adjacent excavation and party structure notices to the adjoining owner and adjoining tenants.

The works were carried out by our client contractor successfully and despite significant engineering of the ground structure no negative affects were found to the neighbouring building or structure.

We were delighted to carry out the final inspection this week with the adjoining owners surveyor and successful bring matter to a close.

Party Wall matters can be very simple or very convoluted and Mason Carey are able to advise both building owners and adjoining owners on responsibility and requirements of the Act.

What is a party wall?

The main types of party walls are:

  • a wall that stands on the lands of 2 (or more) owners and forms part of a building - this wall can be part of one building only or separate buildings belonging to different owners
  • a wall that stands on the lands of 2 owners but does not form part of a building, such as a garden wall but not including timber fences
  • a wall that is on one owner’s land but is used by 2 (or more) owners to separate their buildings

The Act also uses the expression ‘party structure’. This could be a wall or floor partition or other structure separating buildings or parts of buildings in different ownership, such as in flats.
